Pursuant to Regulation (EU) 2016/679 (GDPR) and Italian data protection legislation, Studio Legale Gesuito, as data controller, provides the following information notice.

Categories of data

Identification and contact data (first name, last name, e-mail address, telephone number) provided voluntarily through the contact form, e-mail or telephone; data concerning the matter to be handled during advice or professional engagement, including, where strictly necessary, special categories of data (Art. 9 GDPR) and data relating to criminal convictions and offences (Art. 10 GDPR), processed solely for the purposes of the defence mandate. Browsing data collected by technical cookies as described in the Cookie Policy.

Purposes

Personal data are processed in order to reply to contact requests, to establish and perform the professional engagement and to comply with related legal obligations.

Legal basis

Performance of pre-contractual and contractual measures (Art. 6(1)(b) GDPR), compliance with legal obligations (Art. 6(1)(c)) and the controller's legitimate interest (Art. 6(1)(f)). The processing of special and judicial data is based on Art. 9(2)(f) and Art. 10 GDPR, as necessary to establish, exercise or defend legal claims, as well as on the rules of the Italian code of conduct for lawyers.

Provision of data

The provision of data is voluntary; however, failure to provide the necessary data makes it impossible to reply to contact requests and to accept or continue the professional engagement.

Recipients

Within the limits of the purposes indicated, data may be disclosed to: authorised staff and collaborators of the firm; local counsel, technical consultants, experts and other appointed professionals; judicial and administrative authorities, court offices, counterparties and their counsel; tax advisers and IT service providers acting as processors pursuant to Art. 28 GDPR. Data are never disseminated or transferred to third parties for marketing purposes.

Transfers outside the EU

Data are processed within the European Economic Area. Any transfer to third countries takes place only where an adequacy decision of the European Commission or appropriate safeguards under Art. 44 et seq. GDPR are in place.

Retention

Data are retained for the time necessary to pursue the purposes indicated and in any event in compliance with the statutory terms applicable to the legal profession. In particular: data relating to contact requests not followed by an engagement are retained for a maximum of twelve months; data relating to a professional engagement are retained for ten years from its conclusion, unless different limitation periods or tax and professional obligations apply.

Security

The firm adopts appropriate technical and organisational measures to protect data against unauthorised access, loss, destruction or disclosure, in compliance with the professional secrecy binding on lawyers.

Your rights

You may exercise the rights of access, rectification, erasure, restriction, portability and objection by writing to studiolegalegesuito@gmail.com. You also have the right to withdraw any consent given at any time, without prejudice to the lawfulness of previous processing, and to lodge a complaint with the Italian Data Protection Authority (www.garanteprivacy.it).
